The Australian government uses character assessment to evaluate whether an applicant is a threat to the Australian community or meets the character requirements for entry and residency.Here are some important points to note regarding the S501 character assessment and its relevance to Australian PR visas:Character Assessment Under Section 501 (S501):To meet the character requirements, an applicant must provide accurate and complete information about their criminal history, if any, as part of their visa application. While having a criminal record does not necessarily result in visa refusal, it will be assessed on a case-by-case basis.If an applicant has a significant criminal record or has been associated with criminal organizations, their visa application may be refused or canceled based on the character assessment.     Cancellation of a UK visa can have serious implications for the visa holder and require further steps to ensure that Immigration Rules are not breached.The Home Office reserve the right to cancel your UK visa, the reasons for which can vary from the applicant ceasing to meet the requirements of the Immigration Rules to the withdrawal of sponsorship. The latter may be the case for visa holders under the Skilled Worker route, where their UK employer chooses to cease sponsoring the relevant sponsored worker or, in some instances, the sponsor may lose their licence and subsequently the ability to sponsor the visa holder.     One of my favorite things about my job is attending naturalization ceremonies! I have been to 2, so far, and the tenacity, strength, and perseverance of every single person who is taking the oath of citizenship is palpable. It’s the culmination of years-long journey. Most of my clients arrive at this point because they were victims of trafficking or were abused and neglected by their parents or spouses. The relief I help them apply for (like T or U visas) takes years to be approved. Right now, a U-Visa (meaning they were the victim of a qualifying crime in the US) is taking almost 60 months (5 years) to be approved. During that time, they are lucky if they receive a work permit after their application has been pending for 1-2 years (and that would be an incredibly fast turnaround for USCIS to approve a work permit for this type of visa). Then, after they’ve waited 5 years to be granted a U-Visa, then they need to wait another 3 years to apply for a green card (which can take up to 22 months to be approved) Then, they have to wait another 5 years to apply for citizenship. They’re looking at (and this is if everything goes perfectly right) between 13 - 15 years before they can stand up in court and take the oath of citizenship like my client did today. It’s a sobering reality that I think a lot of people don’t recognize. Even by taking the time to read this post, you’re now more aware than most of the endurance that lots of people must have to make it through to the end of their immigration journey; I know that I didn’t before I started my foray into immigration law 4 years ago. Today was an affirming day that makes me happy to be doing what I am doing!

    📣 Significant increase to the Immigration Health Surcharge is just around the Corner 📣Parliament has now approved a significant hike to the Immigration Health Surcharge. The increase will come into play on 6 February 2024 (at the earliest).So, if you or a prospective employee wants to avoid being caught by the increase, visa applications should be submitted as soon as possible and by no later than 5 February.For most visa applicants there’ll be an increase from £624 per year to £1,035 per year. That will mean, for a five year Skilled Worker visa, an IHS of £5,175 (rather than the current rate of £3,120). For a family of four, the IHS will be £18,110 (rather than the current rate of £10,940). These are significant amounts on top of visa application fees!There’s now a limited window to apply for visas at the lower rate before the increase.
